La democracia representativa bien podría ser llamada democracia de papel si sólo se enfoca en sentido formal a establecer la legalidad de los mecanismos del proceso electoral para acceder al poder por medios constitucionales, pero una vez en el ejercicio del poder el gobierno se desentiende del deber de respetar los derechos humanos y el Estado de derecho, elementos que son consubstanciales a la democracia, vista tal circunstancia, dicho gobierno habría perdido su legitimidad democrática.A diferencia de la democracia representativa en su concepto formal, su ejercicio en sentido sustantivo presupone la inclusión de determinados elementos esenciales, sin los cuales no puede existir democracia representativa en el rigor semántico de esta institución, por esta razón es que ante la dificultad de adoptar una definición de democracia que sea ampliamente aceptada por la comunidad internacional independientemente de la cultura política y social en que están inmersos los Estados, la doctrina se ha decantado en el método de definir indirectamente lo que es democracia en su esquema teórico, esto es, mediante la identificación y análisis de los elementos esenciales que la configuran.Estos elementos esenciales que serán identificados en el desarrollo de esta obra, se erigen como pilares de la arquitectura democrática del Estado, se encuentran íntimamente entrelazados e indisolublemente unidos entre sí, y constituyen en su conjunto el andamiaje del régimen de gobierno democrático que le sirve de fundamento.
