L’objectif du droit international est d’ouvrir la voie pour que chacun puisse vivre sans nuire à l’autre, dans un esprit de coopération et de compromis. Ainsi, l’utilisation équitable et raisonnable des cours d’eau transfrontaliers est justifiable en vertu du droit international de l’eau. Le bassin du Nil, qui comprend les pays riverains du Nil en Afrique du Nord-Est, suscite l’espoir avec l’établissement de l’accord de libre-échange en ouvrant la voie à une utilisation équitable et raisonnable de l’eau du Nil et de ses ressources par tous les pays riverains, qu’ils soient en amont ou en aval. Cependant, avec l’intention d’utiliser le fleuve Nil par les États riverains, principalement l’Égypte, ces derniers insistent pour incorporer le terme indéterminé, élastique, ambigu et non juridique appelé principe de 'sécurité de l’eau' dans l’accord de libre-échange du bassin du Nil, ce qui pourrait leur permettre de préserver leur hégémonie historique sur les pays riverains du Nil. Cela ferme la porte au principe fondamental international qui suggère fortement d’utiliser les fleuves transfrontaliers de manière équitable et raisonnable. En outre, cela fait pencher la balance vers un résultat indésirable, soit le gel du statu quo dans un processus de négociation sans fin, soit des négociations longues d’une décennie qui aboutiraient à une impasse.
