Les entreprises multinationales sont devenues des acteurs clés du nouvel ordre mondial économique. Leur nombre et puissance ne cessent de s’amplifier dans l’ordre international contemporain. Face à cette montée, un débat a commencé par faire rage. Il s’agit de savoir quel est leur statut exacte droit international ? Deux tendances s’opposent en droit international quant au statut juridique international des entreprises multinationales. Il s’agit de la tendance minimaliste et maximaliste. À la fin, du débat opposant l’opinion minimaliste et maximaliste, nous avons constaté que les entreprises multinationales sont en réalité dans un vide juridique international. Aucun traité de droit international ne s’intéresse. Les rares textes internationaux qui les concernent ne sont pas contraignants. Le constant est que les Etats n’ont vraiment pas la volonté d’adopter des normes dures à leur égard, mais aussi la pression exercée par certaines entreprises multinationales (EMN). Mais ce vide juridique ne veut pas forcément dire qu’elle sont complètement absentes devant le droit international. Elles sont prises en compte par le droit international d’une autre manière.
