Studienarbeit aus dem Jahr 2016 im Fachbereich Jura - Öffentliches Recht / Sonstiges, Note: 13 Punkte, Johann Wolfgang Goethe-Universität Frankfurt am Main, Sprache: Deutsch, Abstract: Am 18.04.2016 ist eine umfassende Reform des Vergaberechts in Kraft getreten. Als wichtiger Aspekt der Reform wird dabei die Ausnahmeregelung vom Vergabeverfahren für öffentlich-öffentliche Zusammenarbeit gesehen.Zu Beginn der Arbeit wird geklärt, aufgrund welcher Überlegungen ganz grundsätzlich eine Ausnahme vom Vergabeverfahren für öffentlich-öffentliche Kooperationen gerechtfertigt werden kann. Diese Ausnahmen finden sich im neuen § 108 GWB, der die Regelungen der europäischen Richtlinien in nationales Recht umsetzt, und sind nun erstmals gesetzlich niedergelegt worden. Vor der Reform musste auf eine umfangreiche Rechtsprechung zurückgegriffen werden. Die grundlegende Rechtsprechung soll kurz skizziert werden, um zum einen ein besseres Verständnis über den Prozess der Entwicklung und Ausformung der Ausnahmen zu ermöglichen und zum anderen die inhaltliche Verzahnung von Rechtsprechung des EuGH und nun erfolgter Kodifizierung aufzeigen.Anschließend wird der neue § 108 GWB eingehend betrachtet und untersucht. Dabei werden auch die Beratungen im Gesetzgebungsverfahren betrachtet.
